The Managing IP Awards recognize impactful intellectual property cases annually. This year’s award recognizes Irwin IP’s landmark victory in LKQ Corp. v. GM Global Tech, argued before the en banc Federal Circuit. On May 21, 2024, the court unanimously agreed with LKQ’s position, overturning over 40 years of precedent and remanding the case for further proceedings.
The ruling replaces the long-standing Rosen-Durling test with a new obviousness framework aligned with Supreme Court precedent, marking a significant shift in design patent law. This decision not only secured a major win for our client, LKQ Corporation, but also sets a new standard for design patent litigation nationwide.
