November 2025 – Irwin IP, a part of Miller Johnson, is proud to announce a decisive victory for its clients, Merkur Gaming US and Spintec, in defeating a temporary restraining order (TRO) and preliminary injunction that sought to block Spintec from launching its new casino games at Global Gaming Expo (G2E) in Las Vegas—the gaming industry’s most important international event.
Faced with a TRO motion alleging infringement of two separate patents filed two weeks before G2E, Irwin IP’s team worked around the clock to deliver a comprehensive and forceful defense. Within one week, the team coordinated across continents with the Slovenia-based clients to prepare detailed technical and financial client declarations, an extensive expert report on non-infringement and invalidity, and an economic report addressing irreparable harm—ultimately submitting nearly 1,000 pages of briefing and exhibits to the court.
At the TRO hearing, the court ruled completely in favor of Merkur and Spintec, finding no irreparable harm, the balance of equities favored the defendants, and recognizing that Irwin IP had raised substantial questions of both non-infringement and invalidity. Subsequently, upon representation from plaintiff that it intended to proceed with discovery and file a new preliminary injunction motion, the court denied the pending motion for preliminary injunction without prejudice. However, the case is now proceeding in accordance with the standard discovery process.
